What is a UK work permit?
A work permit is legal permission granted by the Department of Home Affairs to British employers to allow a person to be employed in a qualified full-time position. The employer must apply to the Ministry of the Interior to allow the person to be hired.
What is the procedure for applying for a UK work permit?
You can apply from the UK or outside the UK. The decision on how to apply will depend on the person’s current immigration status and validity period.
What kind of work permit can be issued?
Work permits for various positions can be issued; in the UK, this is not necessarily a shortage of occupations. However, the conditions set must be met to obtain a UK work permit.
To comply with the work permit system, you must be able to prove that you have at least one of the following skills to fill the position.
British title or equivalent
HND [Higher National Diploma] or equivalent degree unrelated to the position, plus one year of relevant work experience
HND [Advanced National Diploma] related to the position o At least 3 years of NVQ [National Vocational Qualification] level 3 or higher expert experience.
If you are applying for a senior or expert position, the person should be able to provide copies of qualification certificates and detailed job certificates to support the application. If registration in a professional organization in the UK [eg, GMC, RIBA] is required, a copy of the registration certificate should be provided.
Do I have to prove that I cannot hold this position from the UK?
In most cases, the British employer can be expected to show evidence that there has been a real attempt to recruit from the UK before applying for a work permit. However, those roles that are considered to be in short supply in the UK do not require evidence of national advertising. For certain senior positions or expert positions, or when employees are currently working in the same company abroad, advertising is usually not required. However, you should seek professional advice as soon as possible to ensure that any application is prepared and meets the standards of the Ministry of the Interior; we do not apply for work permits on behalf of individuals.
Are there other plans to allow foreign nationals to work for us?
The Highly Skilled Migration Program (HSMP) aims to enable people with extraordinary skills and experience to work in the UK. It allows you to enter or stay in the UK without having to work or take advantage of self-employment opportunities. The app is evaluated based on points: 65 points or more are required to qualify.
Other visas allow people to work without a formal work permit. Working holidays, spouse visas, student visas and dependents have the right to work to varying degrees. However, each visa has its own specific set of guidelines and restrictions. It is the responsibility of the British employer to check whether the person has the correct work permit.
